If you’re looking to build a garden room, annexe, home office or other outbuilding within the garden of a Listed Building, it’s important to note that the Town and Country Planning (General Permitted Development) (England) Order 2015 (the ‘GPDO’) specifically excluded your property from having ‘permitted development rights’ (‘PD’) for outbuildings, even if your proposed outbuilding would normally fall within standard PD limits (size, height, use incidental to the house, etc.).

In plain language, this means that the GPDO itself removes PD rights for outbuildings in the gardens of Listed Buildings. The consequence for homeowners is that you cannot rely on Permitted Development rights to erect an outbuilding within the curtilage of a Listed Building.

However, this does not mean that you are unable to install your dream garden room or annexe. Instead, it’s necessary to submit a ‘householder planning application’ to your local planning authority, and in some cases a Listed Building Consent application too. The local planning authority will assess the design and scale of the outbuilding, alongside the impact on the setting and special architectural or historic character of the Listed Building within the curtilage of which you are building.
